GENERAL CONDITIONS OF PURCHASE
1. Object
1.1 These general conditions of purchase (hereinafter, the “Conditions”), are applicable to packaging, packing and similar products (the “Products” or the “Product”) offered by DISTRIBUCION ARC through its website info@distribucionarc, with (the “Website”).
1.2 The Website is owned by ARC DISTRIBUTION, a Spanish company, with registered office at C/ Castell n1, Alaquas, 46017 (Valencia), provided with B55480172 .
1.3 ARC DISTRIBUTION (“ARC DISTRIBUTION”) provides information about the Products and offers the possibility of purchasing them through the Website. People who intend to purchase the Products must complete the respective registration form prior to the purchase process and follow the instructions provided. ARC DISTRIBUTION will indicate to you through the Website.
1.4 These Conditions, together with the Legal Notice contained on the Website, are the only conditions applicable to the use of the Website and the purchase of the Products through it and replace any other conditions. Consequently, the Client (the "Customer”) who accesses the Website, registers or makes a purchase of Products through the Website agrees to be bound by these Conditions and the Legal Notice as they are drafted at the time of accessing the Website.
1.5 Every Client who accesses and registers on the Website must be at least eighteen (18) years old or, otherwise, have the authorization of his or her parents or legal guardians.
1.6 The contract is formalized in the Spanish language and is regulated by Spanish legislation, specifically by Royal Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws ("LDCyU”) and by Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (“LSSI”).
2. Product Information
2.1 Photographs, graphic or iconographic representations and videos relating to the Products of ARC DISTRIBUTION, as well as trade names, brands or distinctive signs of any kind contained on the Website, are intended to provide the most descriptive information about the Product. ARC DISTRIBUTION will take all reasonable care to ensure that the descriptions of the Products appearing on the Website are correct. However, the Customer must bear in mind that they are for guidance purposes only and, consequently, are not exhaustive, and therefore there is no guarantee that the descriptions and images of the Products are accurate, complete, reliable, up-to-date or error-free.
2.2 ARC DISTRIBUTION reserves the right to decide, at any time, the Products offered through the Website. In this way, ARC DISTRIBUTION may, at any time, remove or add Products, it being understood, unless otherwise provided, that the new Products will be governed by the provisions of the Conditions that are in force at that time.
2.3 In the event that, due to circumstances of force majeure, a Product is not available after the purchase has been made, ARC DISTRIBUTION will inform the Customer by email of the total or partial cancellation of the order, and in turn, the Customer will have the right to have the amount paid for the Product refunded. The partial cancellation of the order does not give the right to cancel the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the Customer in accordance with the provisions of these Conditions.
3. Placing Orders
To place an order, the customer must follow a series of simple instructions that appear on the Website.
3.1. The customer must select the products they wish to purchase by pack or individually depending on the desired product. Once the selection of the product has been completed, they must click the “Add to cart” button.
3.2. Once the product has been selected, the customer has the option of choosing the compatible items that each product offers in their case. Once the selection of said product has been completed, they must click on the “add to cart” button.
3.3 These products will be automatically added to the customer's shopping cart, located in the upper right corner, indicating the price of the products added. The customer can consult all the items contained in his shopping cart at any time.
3.4. The process of adding other products to the cart will be carried out in the same way.
3.5 Once the purchase is complete, the customer must click on their cart (located in the upper right corner), the purchase summary will be displayed and they must press the “Complete purchase” button.
3.6 The customer must register to be able to place an order. If you are a new user, you must fill in the required fields during login. If you are already a registered user, you must click on the registered customer tab and enter your email address and password.
3.7 Once registered, the customer must choose between warehouse collection or delivery. There are two types of delivery: STANDARD DELIVERY (3-6 working days) or EXPRESS DELIVERY (24H – 48H working days) which entails an additional charge. If you choose warehouse collection, you must choose the address of our warehouse.
3.8 The customer must then choose the payment method. If the customer has a promotional code, he or she must enter it at that time so that the corresponding discount is applied before proceeding to pay for the order. Payment by bank card, Paypal or bank transfer is permitted for order delivery. If the customer chooses to collect from the warehouse, the methods described above will be available, plus cash payment upon collection.
3.9. The customer will see a detailed summary of his purchase: the products and quantities he has ordered, the total amount (including taxes and shipping costs), the shipping address or the address of our warehouse (for orders with warehouse collection), the payment method, the shipping method and a field where the customer can indicate any notes regarding the order. All of this information can be modified using the modify button (located next to the various sections of the order details). In the case of making payment by bank transfer, the customer will see below the order details the bank account number where the payment must be made.
3.10. Finally, the customer must press the Confirm Purchase button, located below the order details. They will receive an email confirming their order.
3.11 By placing an order, the Customer acknowledges and declares that he/she has read all the instructions provided during the checkout process and fully accepts these Conditions. The Customer places an order for Products through the Website by clicking on the “Place order” button at the end of the purchasing process.
3.12 Once the order has been sent, a page will appear with the phrase “Thank you for your purchase” and within 24 hours of receiving acceptance from the seller, ARC DISTRIBUTION, the Client will receive at the email address that he/she has provided to ARC DISTRIBUTION, an acknowledgement of receipt confirming receipt of your acceptance together with a summary of the conditions, information on the characteristics of the Products purchased, the price, the method of payment and information on shipping costs.
3.13 If confirmation of an order does not arrive within 24 hours of its formalization, the business day being the day after the order was formalized, the Client may contact ARC DISTRIBUTION For assistance, please email info@distribucionarc.com or call 641.229.369. Customers may also contact ARC DISTRIBUTION when you have any questions regarding an order. For faster service, Users are advised to have their order number available.
4. Shipping and Delivery
4.1 Orders are processed, handled and delivered on business days and during business hours from 9am to 6pm. Orders placed on Fridays outside business hours or on weekends and public holidays will be processed on the following business day.
4.2 Shipping costs are the responsibility of the Customer and are reflected in the invoice.
4.3 The maximum delivery period for the Products is 30 calendar days from the conclusion of the contract.
Shipments to Spain (mainland) take approximately 2 to 6 business days once payment has been confirmed by the Customer. For international shipments, the delivery time may be between 3 to 7 business days, depending on the destination, the service selected and the transport company indicated. Once the package is delivered to the courier service, the Customer will receive an email notification with the shipment tracking number.
ARC DISTRIBUTION is not responsible for delays in the delivery of orders, or the impossibility of carrying them out, when the cause is due to an event of force majeure, and therefore, beyond the control of ARC DISTRIBUTION. Among other causes, we understand that there is force majeure in the following cases, not exhaustive: accidents, strikes, riots, threats or terrorist attacks, fire or explosion, meteorological causes or natural disasters such as storms, floods, earthquakes, subsidence, epidemics, as well as any problem beyond the control of ARC DISTRIBUTION in the means of transport or telecommunication systems. To the extent possible, once the cause of impossibility or delay has ended, ARC DISTRIBUTION will make every effort to resume business activities and meet its obligations and shipments.
4.4 All purchases are subject to prior authorization from the bank. Only purchases with prior authorization will be processed. If the order cannot be processed, the Customer will receive an email.

5. Method of payment
Payment methods accepted by ARC DISTRIBUTION are as follows:
5.1 Card
The following forms of payment will be accepted:
– Visa
– MasterCard
– American Express
Products will be charged at the time of placing the order.
For Customer security, the Customer's name and billing address must match those on the credit card used to make the payment. We reserve the right to cancel any order that does not meet these criteria.
All credit card holders are subject to validation checks and authorization by the card issuer. If the issuer of the Customer's payment card denies, or for any reason does not authorize, payment to us, whether prior to or subsequent to a payment, we will not be liable for any delay or non-delivery.
5.2 Paypal
Paypal linked to your debit card, credit card or bank account does not apply any costs except in the case of currency conversion.
5.3 Bank transfer
Once payment has been made, the Customer must send proof of payment indicating their order number to the email address info@distribucionarc.com or to the number 641229369

5.4 Cash on pick up
The Customer may choose the option of personally collecting the purchased Products, by going to the following address:

This payment method must be indicated at the time of placing the order and the exact amount of the purchase must be provided at the time of collection, as there is no cash register. In order to collect the Product, the Customer must have received a notification electronically along with a number confirming that the Product is ready to be collected.
6. Gshipping charges
6.1 Shipping costs are calculated based on the quantity of product purchased, the volume it occupies and the destination.
6.2 The Canary Islands, Ceuta and Melilla are not part of the customs territory of the European Union, so shipments may be subject to taxes and/or customs duties. In most cases, the fees are charged at the time of delivery of the package, although the Customer may receive a notification by mail asking him/her to go in person to pay these fees in order to receive the package. The amount of the fees may vary depending on the weight/amount of the package. In the case of shipments to the Canary Islands, ARC DISTRIBUTION includes in the cost of shipping the Single Administrative Document (“DUA”) for export, and upon delivery of the Product, the Client/recipient must pay the Import DUA and the Canary Islands General Indirect Tax (“IGIC”).
7. Order inquiries
7.1 Without prejudice to the provisions of point 4.5 of these Conditions, the Client who has created an account on info@distribucionarc.com You can check the status of your orders by visiting the “My Orders” page in the “My Account” section.
7.2 When the Customer clicks on the “Order Status” page, he/she will be required to log in with his/her email address and password. The order summary page will provide the Customer with detailed information about his/her current and previous orders. Once the order has been shipped, the relevant tracking number will be displayed, if available.
8. Cancellation of orders
8.1 ARC DISTRIBUTION may cancel orders for the following non-exhaustive reasons:
– Inability to process payment information.
– Impossibility of making delivery to the address provided.
– Cancellation at the request of the Client.
– Items not available.
9 Other features of the purchase
9.1 Shipments are made by courier or groupage service.
9.2 Shipping costs include Value Added Tax (VAT) in all cases.
9.3 Shipment means the delivery of the Products to the address specified by the Customer during the ordering process.
9.4 ARC DISTRIBUTION delivers orders to the courier service within a maximum of 48 hours.
10. Right of withdrawal
10.1 The Customer may exercise the right of withdrawal without giving any reason and return the Product to ARC DISTRIBUTION Within fourteen (14) days from the day on which you acquire physical possession of the Product.
10.2 To do so, the Client will be required to notify in writing ARC DISTRIBUTION to the email address info@distribucionarc.com indicating the necessary data to locate the order in question. As soon as ARC DISTRIBUTION receive the email with the order details, the Customer will be informed of the procedure to follow.
10.3 For additional information on the content and instructions for exercising the right of withdrawal, please contact our Customer Service.
10.4 The right of withdrawal will not apply to the delivery of the following Products:
- Made according to the Client's specifications or clearly personalized.
- That can deteriorate or expire quickly.
– Sealed items that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.
11. Effects of withdrawal
11.1 The Client must send the Product, in perfect condition, to the address indicated by the Client. ARC DISTRIBUTION, no later than within fourteen (14) calendar days from the date on which you communicate your decision to withdraw to ARC DISTRIBUTION. In these cases, ARC DISTRIBUTION will reimburse the Customer for all costs of the original purchase except for the direct cost of returning the Products, which will be borne by the Customer. Furthermore, the Customer shall only be liable for any decrease in the value of the goods resulting from handling them other than what is necessary to establish their nature, characteristics or functioning.
11.2 ARC DISTRIBUTION will use the same means of payment that the Client used for the initial transaction.
ARC DISTRIBUTION may withhold the refund until it has received the Product(s) returned by the Customer or until the Customer provides proof of having returned the Product(s), whichever occurs first.
12. Warranty
12.1 ARC DISTRIBUTION is responsible for any lack of conformity that may appear in the Product during a period of two (2) years from delivery. Therefore, if the Product is defective, DISTRIBUCION ARC will be responsible for collecting it and exchanging it for another one in identical conditions, taking charge of the costs associated with this return and exchange (with the exception of those additional costs resulting from choosing an express delivery method, in which case the Customer must assume the extra cost).
12.2 In order to manage the incident, the Client must notify ARC DISTRIBUTION by email to info@distribucionarc.com stating the reason for the incident, the order number, the delivery note, and photographs of the damaged or incorrect Product so that the situation can be assessed. To exercise the warranty right, the proof of purchase or delivery note must be available.
Once this information is received, ARC DISTRIBUTION will contact the Client to explain the procedure to follow.
12.3 The Client must inform ARC DISTRIBUTION of the lack of conformity of the Product within two (2) months from becoming aware of it.
12.4 In the event that it is not objectively possible to replace the Product with another of the same kind, ARC DISTRIBUTION will proceed to refund the price thereof.
12.5 In no case will the warranty provided for in point 12.1 cover negligent or violent use of the Product or damage resulting from manipulation or intervention of the Product.
It is equally important that any instructions for use or installation of the Products delivered are followed at all times, and in case of doubt, you should contact ARC DISTRIBUTION to receive advice on the use of the Product.
13. Taxes
Prices include Value Added Tax (VAT) in all cases, as well as any applicable taxes or fees.
14. Prices
The Products will be sold at the price indicated, the price valid at the time of confirmation of the order by the Customer being the one in effect.
15. Validity
ARC DISTRIBUTION reserves the right to modify prices, articles, offers and other commercial conditions without prior notice.
16. Resignation
16.1 The lack of request by ARC DISTRIBUTION strict compliance by the Client of any of the obligations assumed by the Client under a contract or these Conditions or the failure to exercise by ARC DISTRIBUTION of any rights or actions that may correspond to it by virtue of said contract or the Conditions, shall not constitute a waiver or limitation of said rights or actions nor shall it exonerate the Client from complying with such obligations.
16.2 No waiver by ARC DISTRIBUTION to a specific right or action will constitute a waiver of any other rights or actions arising from a contract or the Conditions.
17. Modification of the Conditions
ARC DISTRIBUTION reserves the right to review and modify these Conditions at any time. The Client will be subject to the Conditions in force at the time of use of the Website or placing each order, unless required by law or by decision of government agencies ARC DISTRIBUTION may have to make retroactive changes to these Conditions, in which case any changes will also affect any orders previously placed by the Customer.
18. Complaints, comments and suggestions
18.1 A complaints form is made available to Clients and may be requested by sending an email to the address info@distribucionarc.com.

19. Data protection
19.1 For the purposes of the provisions of Organic Law 03/2018, of December 5, on Data Protection and Guarantee of Digital Rights (LOPD), ARC DISTRIBUTION informs the Client that any personal data provided at any time and voluntarily to our company or our employees will be included in an automated personal data file created and maintained under the responsibility of ARC DISTRIBUTION and will be processed for the exclusive purpose of processing your order request, as well as any queries or suggestions made by the Customer.
19.2 The Client may exercise his right of access, rectification, cancellation and opposition at any time, by sending his request to the email address info@distribucionarc.com
19.3 In order to ensure that the information contained in our files is always up-to-date and error-free, we request that the Client inform us as soon as possible of any changes or corrections to their personal data.
19.4 We inform you that all necessary technical and organisational security measures have been adopted to guarantee the protection of your personal data and prevent its alteration, loss, processing and/or unauthorised access, taking into account the state of the art, the nature of the data stored and the risks to which they are exposed, all in accordance with the provisions of the LOPD and its implementing regulations.
19.5 Except in the fields where expressly indicated otherwise, the delivery of information required in the data request forms is mandatory for the correct management of the orders, queries and suggestions made by you. Failure to complete the fields determined as mandatory, or the provision of incorrect data, will make it impossible for the Company to process the data. ARC DISTRIBUTION can properly manage them.
20. Applicable law and jurisdiction
20.1 These Conditions are governed by and construed in accordance with Spanish law.
20.2 The parties agree to submit the decision of the matter raised to the Courts and Tribunals of the city of Valencia (Spain) except in the case in which the Client is a consumer for the purposes of article 3 LDCyU, in which case the Courts and Tribunals of the Client's domicile or of ARC DISTRIBUTION, as chosen by the Client.
